I recently got a breathalyzer and blew a .000, they then gave me one more breathalyzer and I blew a .001. Even though I wasn't drinking they still gave me a minor. Do you have any advice on my situation on what I should do or can do to get rid of this or make it less severe. What could i take to get a .001 on a breathalyzer? Do you have any advice?
The court should only look at the first two decimal points. I doubt they would consider a .001. If that is all the evidence they have, I would be surprised if you were convicted.
However, it is illegal to consume or possess. If you were in possession of alcohol, it would not matter what your test result was. What could i take to get a .001 on a breathalyzer? Do you have any advice?
Most breathalyzers used by law enforcements have a margin of error of +/- 0.001. I would get a dui lawyer and argue that his breathalyzer was not calibrated properly. even if it was, it's still possible that the device was reading in the margin of error.
if the device was a semi conductor breathalyzer versus a fuel cell breathalyzer, then the margin of error could be .01 or .02.
Look at Bruce's advice too. He's got a good comment.
The legal limit is usually .08 and since you blew a .001, you're not even close to that.
However, if you're a minor and they are enforcing ';zero tolerance';, you could check things like your mouthwash (which often contains up to 25% alcohol).
The test is also not supposed to be administered within a certain period after burping. Perhaps you did that right before the second test?
either you found somebody in uniform who's stupid, or there is more to the story than is presented.
if that's the whole story though, it'll get laughed out of court.
Im going to have to go with Ben and Fridaddy on this one
That officer just wanted to take you for a ride and he wanted to do it enough to have to fill out the paper work involved with doing it
Don't listen to the first idiot. You can blow a .001 from drinking coffee. Any food/drink/cigarette can effect a breathalyzer if consumed right before the test. Get a lawyer and take this to court.
Answer this:
Had you had any alcohol?
If so, than you can grow up and take responsibility for your actions.
Ben I think your right, there is more to this story than is posted.
