Need Legal Advice On How To Get My Grandmother's Medical Records...?

We just found my grandmother last year and visited her for the first time in my life. She is in a nursing home in California and has been for quite sometime. My mom (her daughter) and I want to know what her history has been and we can't just ask her because of her failing health and strong accent. I know with all of the hepa laws things are more difficult to obtain, but we need to find a way around it so that we know family history, medical history, ect. Any advice as to how I can do this? Legally unless she's deemed incompentant there's nothing you can do, and there's no way they could release them to you. If she's not been deemed incompentant you'll need to get a lawyer to help you have her deemed incompentat. Also if she has appointed someone to be her guardian or a court has appointed someone to be her guardian then that person is the only one that legal can access her medical record.Need Legal Advice On How To Get My Grandmother's Medical Records...?

You can't....unless you get your grandmother to sign a power of attorney, to let you have access to med records, you're out of luck.
You aren't going to be able to just ask her doctor for medical records. The only way you would be able to obtain them would be to obtain a medical power of attorney from your grandmother, which is unlikely to happen.





Your best bet is to get to know the staff at her nursing home, and develop a rapport, to try to learn more about her status and her history. You should realize that the nursing home staff may be very suspicious of your motives, especially if your grandmother has any money. Try to build trust, and see if you can develop enough of a relationship with the people in your grandmother's life to learn more about her.
